These Terms & Conditions (“Terms”) govern access to and use of PropSiteAI (the “Platform”), a software-as-a-service product operated by Cheese Digital & Design Solutions - F.Z.C (Arabic: تشيز ديجيتال آند ديزاين سوليوشنز - ش.م.ح), also referred to as CHSE (“we”, “us”, or “our”).

By creating an account, clicking “I agree”, subscribing, or otherwise using PropSiteAI, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Platform.

1. Legal entity & licence

Cheese Digital & Design Solutions - F.Z.C is a Free Zone Company (Limited Liability) licensed by the Free Zones Authority of Ajman (Ajman Free Zone).

PropSiteAI is operated under the above licence as a product of Cheese Digital & Design Solutions - F.Z.C (CHSE).

2. About PropSiteAI

PropSiteAI helps real estate agencies create, host, and manage websites, property listings, content, and related digital tools. Features may include templates, admin tools, media storage, and AI-assisted content generation.

3. Eligibility & accounts

You must be legally able to enter into a binding contract and provide accurate registration details (including company/agency name, contact name, email, and phone). You must keep your credentials confidential and are responsible for activity under your account. Notify us promptly of any unauthorised use.

If you register on behalf of a company, you confirm you are authorised to bind that company to these Terms.

4. Acceptance of Terms at registration

When you register, you must actively confirm that you have read and agree to these Terms and the Privacy Policy. We may record the time of acceptance and related technical details (such as IP address) for compliance and audit purposes.

5. Subscriptions, trials & payments

Access may be free, trial-based, or paid according to the plan selected at signup or in your dashboard. Fees, billing cycles, and inclusions are as displayed at the time of purchase unless otherwise agreed in writing.

Except where required by applicable UAE law or expressly agreed by us in writing, fees are non-refundable. We may change pricing with reasonable notice; continued use after the change takes effect constitutes acceptance of the new pricing for subsequent billing periods.

You are responsible for applicable taxes. Where Corporate Tax or other UAE taxes apply to our supplies, invoices may include statutory tax details consistent with our tax registration.

6. Your content & websites

You retain ownership of content you upload (including listings, images, text, logos, and branding). You grant us a limited, non-exclusive licence to host, process, display, and transmit that content solely to operate the Platform for you.

You represent that you have all rights needed to publish such content and that it does not violate law or third-party rights (including privacy, publicity, and intellectual property). You are solely responsible for the accuracy of property information and for compliance with real-estate, advertising, and consumer rules applicable to your business.

7. Data isolation — your data stays yours

PropSiteAI is built as a multi-tenant platform. Each customer organisation has its own workspace. Your listings, website content, media, contacts, agents, settings, and other account data are stored and accessed in association with your organisation only.

You may email us at any time to request a copy of your account data or deletion of your account/data. See our Privacy Policy for how those requests are handled.

You agree not to:

We may suspend or remove content or accounts that breach these Terms or create legal, security, or operational risk.

9. AI-assisted features

Some features may generate text or suggestions using artificial intelligence. AI output can be inaccurate or incomplete. You must review and approve all content before publishing. Do not submit unnecessary sensitive personal data in AI prompts.

10. Third-party services

The Platform may rely on third-party infrastructure (hosting, email, analytics, payments, domain services, and similar). Those providers have their own terms. We are not responsible for outages or policies outside our reasonable control.

11. Intellectual property

PropSiteAI software, templates, design systems, documentation, and trademarks remain the property of Cheese Digital & Design Solutions - F.Z.C and its licensors. Your subscription grants a limited, non-transferable right to use the Platform for your internal business purposes during the subscription term. No other IP rights are transferred.

12. Confidentiality

Each party may receive confidential business information from the other. The receiving party will use such information only to perform under these Terms and will not disclose it except to personnel/service providers under confidentiality obligations, or as required by law.

13. Suspension & termination

We may suspend or terminate access for breach, non-payment, security risk, or legal requirement. You may stop using the Platform at any time; unless otherwise agreed, paid plans end at the close of the then-current billing period. Upon termination, your right to access the Platform ends. We may delete or disable hosted sites and data after a reasonable retention period, subject to our Privacy Policy and legal obligations.

14. Disclaimers

The Platform is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim warranties of uninterrupted or error-free operation, fitness for a particular purpose, and non-infringement. Templates and sample content are starting points only; you are responsible for customising them for your business and regulatory needs.

15. Limitation of liability

To the fullest extent permitted by applicable law, Cheese Digital & Design Solutions - F.Z.C shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity arising from use of PropSiteAI.

Our aggregate liability for claims relating to the Platform in any twelve (12) month period shall not exceed the fees you paid to us for PropSiteAI in the three (3) months immediately preceding the claim (or AED 1,000 if no fees were paid), except where liability cannot be limited under UAE law.

16. Indemnity

You will indemnify and hold harmless Cheese Digital & Design Solutions - F.Z.C and its officers, employees, and agents from claims, losses, and expenses (including reasonable legal fees) arising from your content, your websites, your misuse of the Platform, or your breach of these Terms or applicable law.

17. Governing law & disputes

These Terms are governed by the laws of the United Arab Emirates, including federal laws and regulations applicable to free zone companies licensed by the Free Zones Authority of Ajman, without prejudice to mandatory protections that cannot be waived.

Courts of competent jurisdiction in the UAE (including those with jurisdiction over Ajman / Ajman Free Zone matters, as applicable) shall have jurisdiction over disputes arising from these Terms, unless the parties agree in writing to arbitration.

18. Changes

We may update these Terms from time to time. The “Last updated” date on this page will change when we do. Material changes may also be communicated by email or in-product notice. Continued use after changes become effective constitutes acceptance of the revised Terms.
